Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SysWise platform and its suite of applications — including DayWise, CricWise, PayWise, TaskWise, and HealthWise — operated by SysWise and accessible at syswise.lk. By creating an account or using any part of our services, you agree to these Terms. If you do not agree, do not use our services.

1. Eligibility

You must be at least 13 years old to use SysWise. By using our services, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Use a strong password and keep it confidential.
  • Notify us immediately at syswise.lk@gmail.com if you suspect unauthorised access.
  • Not share your login credentials with anyone.
  • Not create accounts for others without their consent.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Acceptable Use

You agree to use SysWise and its applications only for lawful purposes. You must not:

  • Use the services to harass, threaten, or harm others.
  • Upload or transmit malicious code, viruses, or any content that is unlawful, defamatory, or infringing.
  • Attempt to gain unauthorised access to any part of our systems, other users' accounts, or our backend infrastructure.
  • Scrape, crawl, or systematically extract data from our platform without express written permission.
  • Use our services to engage in commercial activities not authorised by SysWise (e.g., reselling access).
  • Interfere with or disrupt the integrity or performance of our services.

4. User-Generated Content

Content you create within our applications — such as task names, match records, expense entries, group names, and health logs — remains yours. By entering content into our platform, you grant SysWise a limited licence to store, process, and display that content solely for the purpose of providing the services to you.

You are solely responsible for the accuracy and legality of content you submit. We do not routinely review user content but reserve the right to remove content that violates these Terms.

5. Groups and Shared Features

SysWise applications include shared group features (e.g., expense groups in PayWise, cricket teams in CricWise). When you create or join a group:

  • Other group members may see your name and the data you contribute to that group.
  • Group administrators may add or remove members and manage group settings.
  • You may leave a group at any time, but historical records you contributed may remain visible to other members.

6. Intellectual Property

All content, design, code, trademarks, logos, and materials on the SysWise platform are the property of SysWise or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of our platform without prior written consent.

The SysWise name, logo, and application names (DayWise, CricWise, PayWise, TaskWise, HealthWise) are trademarks of SysWise. Nothing in these Terms grants you the right to use them.

7. Availability and Changes to Services

We aim to keep our services available at all times, but we do not guarantee uninterrupted access. We may perform scheduled or unscheduled maintenance that temporarily interrupts service. We will make reasonable efforts to notify users of significant downtime in advance.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice where possible. We are not liable for any loss resulting from service modifications or interruptions.

8. Disclaimer of Warranties

The SysWise platform and its applications are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the services will be error-free, secure, or uninterrupted, or that any defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SysWise and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or profits — arising out of or related to your use of, or inability to use, our services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the services shall not exceed the amount you paid to us in the twelve months preceding the claim (which, for free services, is zero).

10. Indemnification

You agree to indemnify and hold harmless SysWise and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the services, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

You may stop using our services at any time. You may request deletion of your account by emailing syswise.lk@gmail.com.

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use our services ceases immediately. Sections 6, 8, 9, and 10 survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of our services after revised Terms are posted constitutes your acceptance of the changes. If the changes are material, we will make reasonable efforts to notify registered users.
